Outside the POPIA box

The one thing about life is that it is constantly changing, and a conversation with a friend recently got me thinking about a policy change which is going to affect business in South Africa.


Client information, be it a contact number, email address or in fact any other detail which is a personal identifier is an incredibly important business resource, because this is how we generate leads, potential business and hopefully income in the end.

South Africa's data protection act, POPIA (Protection of Personal Information Act) was implemented in July 2020, and will become fully active in June this year, and is focused entirely on the security of personal information.

My question is this, how does the implementation of POPIA affect creatives, small business owners and those of us simply trying to make a living?

Is a simply privacy policy enough, and does this provide sufficient compliance?

Do we simply have to ask for permission to obtain a client's contact details?

My understanding, however, is that the Act is far more comprehensive, and dictates how personal information is collected, processed, stored, updated and even deleted when required.

How is this affecting your business, and what tips do you have for anyone working on meeting these legislative requirements?
